One of the most misunderstood questions in Texas vehicle law is whether the Texas Lemon Law covers used cars.
The answer is:
Sometimes—but not in the same way it protects qualifying new vehicles.
TxDMV says that Texas warranty-performance law may provide assistance for certain used vehicles, particularly when the manufacturer’s original warranty remains in effect. However, only new vehicles qualify for the TxDMV Lemon Law’s refund-or-replacement remedy.
When Can a Used Vehicle Receive Protection?
TxDMV identifies two important situations.
A used vehicle may receive warranty-performance protection when:
- The vehicle remains covered by the manufacturer’s original warranty—not merely an extended service contract; or
- The defect started and was reported to the dealer while the manufacturer’s original warranty was still in effect and the defect continues to exist.

No, according to TxDMV’s current guidance.
TxDMV expressly states that only new vehicles qualify for refund or replacement through the Lemon Law process.

A used vehicle may have repair or warranty-performance rights without qualifying for the same administrative repurchase remedy as a new vehicle.
Does an Extended Warranty Count?
TxDMV specifically distinguishes the manufacturer’s original warranty from an extended service contract when discussing used-vehicle coverage.
An extended service contract may create contractual rights, but it is not automatically equivalent to the original manufacturer warranty for Texas Lemon Law purposes.
What Other Laws Could Apply?
A used vehicle outside the Texas new-vehicle Lemon Law may still have other legal protections.

What if the Dealer Sold the Car “As Is”?
An “as is” sale can affect certain warranty rights.
But it does not necessarily erase a separate manufacturer warranty that remains legally effective.
