Florida Lemon Law Offset vs Refund: Understanding the Deduction

If your vehicle qualifies under the Florida Lemon Law, you may be entitled to a refund or replacement.

But many consumers ask:

“How much will Florida deduct for mileage?”

Florida allows manufacturers to deduct a reasonable offset for use, commonly called a mileage deduction.


Florida Lemon Law Mileage Offset Formula

Florida generally calculates the usage deduction as:

(Miles driven before first repair attempt ÷ 120,000) × Purchase price

The mileage used is typically:

✅ The odometer reading at the first repair attempt for the defect
Not the mileage at buyback.


Florida Example

Purchase price: $42,000
First repair: 6,000 miles

6,000 ÷ 120,000 = 0.05
0.05 × $42,000 = $2,100

That amount may be deducted from the repurchase refund.


Florida Important Points

  • The defect must substantially impair use, value, or safety.
  • Repair attempts must occur during the Lemon Law rights period (generally first 24 months).
  • The offset applies only to the mileage before the first repair attempt.

Even with the offset, many consumers recover most of what they paid.
