California Lemon Law Mileage Offset: What It Means for Your Refund

California is one of the most consumer-friendly lemon law states — but it still allows a mileage deduction.


California Mileage Offset Formula

California uses a slightly different denominator:

(Miles at first repair attempt ÷ 120,000) × Purchase price

California law refers to this as a “mileage offset” or “usage deduction.”


California Example

Vehicle purchase price: $60,000
First repair: 5,000 miles

5,000 ÷ 120,000 = 0.0417
0.0417 × $60,000 = $2,502

This is the usage deduction subtracted from the refund.


Important California Details

  • The offset only applies to mileage before the first repair attempt.
  • California also allows recovery of incidental damages.
  • Attorneys’ fees may be recoverable under Song-Beverly.
