    Describe your case briefly

Being harassed by a debt collector? Here’s what happens next.

Here is a simple, step-by-step overview of our process so you know what to expect.

Step 1: Quick intake (5–10 minutes)

We’ll have you answer a few questions to understand what’s happening:
    • Who is contacting you (company name, phone numbers, letters)
    • How they’re contacting you (calls, texts, letters, voicemail)
    • What they said or threatened
    • When it started and how often it’s happening
Goal: confirm whether this looks like a potential FDCPA issue and what we need to review.

Step 2: You send us the key proof (usually same day)

We’ll request a short set of documents/screenshots (see checklist below).
If you don’t have everything, that’s okay — send what you do have.
Goal: get enough evidence to evaluate the claim quickly.

Step 3: Attorney review + issue spotting

We look for common FDCPA violations, like:
    • Harassment or repeated calls
    • Threats they can’t legally make
    • Calling you at prohibited times or at work after being told not to
    • Misrepresenting the debt or who they are
    • Failing to provide required notices
Goal: identify the strongest legal theories and any deadlines/risks.

Step 4: Strategy call (next steps + options)

    We’ll explain, in plain English:
    • What we think is happening
    • What your options are
    • What we recommend doing next
    • What we need from you (if anything)
Goal: you leave the call knowing the plan.

Step 5: We take action (demand, dispute coordination, or lawsuit evaluation)

Depending on the facts, we may:
    • Send a representation/cease contact letter
    • Request validation and preserve evidence
    • Evaluate whether filing a lawsuit makes sense
Goal: stop the conduct and pursue the best path forward.

Step 6: Resolution path (negotiation or litigation)

If the matter moves forward, we handle communications and push it toward resolution.
You’ll get updates as key milestones happen.
Goal: minimize stress and keep you informed.

    Step 7: Wrap-up + next-problem prevention

If we resolve the FDCPA issue, we’ll flag related issues we often see alongside it (when relevant), like:
    • Credit reporting problems (FCRA)
    • Debt lawsuit defense timing issues
    • Identity theft red flags
Goal: prevent the same problem from repeating under a new name.

FDCPA Doc-Ready Checklist (What to Gather)

The more you can share, the faster we can evaluate your situation. Don’t worry if you don’t have everything.

    A) Call/Contact Evidence (most important)

    • Screenshots of call logs showing repeated calls (with dates/times)
    • Voicemails (audio files if possible, or written summaries)
    • Screenshots of texts or messages
    • Any emails from the collector

    B) Letters and Notices

    • Photos/scans of every letter you received (front + back)
    • The envelope (sometimes the postmark/date matters)
    • Any “validation notice” or itemized breakdown

    C) Who the collector is

    • Company name(s) used
    • Phone number(s) they call from
    • Website or email address (if shown)
    • Names/IDs of representatives (if provided)

    D) What they said (write this down if you can)

    • Threats (lawsuit, wage garnishment, arrest, “sheriff,” etc.)
    • Claims about the amount owed
    • Statements like “we’re from the legal department” or “we’re the original creditor”
    • Whether they contacted family, employer, or coworkers

    E) Your timeline (even rough is fine)

    • When the contact started
    • How often they contact you
    • Whether you told them to stop calling / not call at work (and when)

    F) Related documents (helpful, not always required)

    • Any prior payment records or settlement agreements
    • Any court papers if you were sued (summons/complaint)
    • Credit report screenshots if you believe they’re reporting inaccurately
If you’re not sure what’s relevant, send it anyway — we’ll sort it.  You can upload them to your form above, or email the documents to us at intake@ginsburglawgroup.com.
